Protocol Extending The Agreement Between The Government Of The Union Of Soviet Socialist Republics And The Government Of The Republic Of Finland Regarding Fishing And Sealing To An Area In The Gulf Of Finland To The East Of The Island Of Suursaari (Gogland)

The Government of the Republic of Finland and the Government of the Union of Soviet Socialist Republics,

Having regard to the favourable development of relations between Finland and the USSR, founded on the 1948 Finnish-Soviet Treaty of Friendship, Co-operation and Mutual Assistance, and to the Agreement signed this day by the Contracting Parties concerning the boundaries of sea areas and of the continental shelf in the Gulf of Finland,

Considering that the Government of the Union of Soviet Socialist Republics, in compliance with the wishes of the Government of the Republic of Finland, has expressed its willingness to grant Finnish nationals the right to engage in fishing and sealing in Soviet territorial waters in the Gulf of Finland within an area to the east of the island of Suursaari (Gogland),

Having regard to the Agreement of 21 February 1959 between the Government of the Republic of Finland and the Government of the Union of Soviet Socialist Republics regarding fishing and sealing,

Have decided to conclude this Protocol and have for that purpose appointed their plenipotentiaries, who, having exchanged their full powers, found in good and due form, have agreed as follows :

Article 1

The Government of the Union of Soviet Socialist Republics agrees to grant nationals of the Republic of Finland the right to engage in fishing and sealing in Soviet territorial waters in the Gulf of Finland within an area to the east of the island of Suursaari (Gogland) under the conditions laid down in the Finnish-Soviet Agreement of 21 February 1959 regarding fishing and sealing and in the letters exchanged by the Contracting Parties on 21 February 1959 on the occasion of the signing of the said Agreement.

The new area within which Finnish nationals are to be granted the right to engage in fishing and sealing shall be bounded by lines passing through the following points :

1. 60°13'42" north latitude, 27°27'50" east longitude;

2. 60°12'19" north latitude, 27°18'01" east longitude;

3. 60°08'49" north latitude, 27°04'36" east longitude; and

4. 60°08'49" north latitude, 27°27'50" east longitude,

as shown on chart No. 403 (date of issue : 1964), which is annexed to this Protocol.

The aforementioned Finnish-Soviet Agreement of 21 February 1959, hereinafter referred to as "the Agreement", shall apply to fishing and sealing in the new area, subject to the changes set out in articles 2-8 of this Protocol.

Article 2

The right to engage in fishing and sealing in the new area shall be granted to all nationals of the Republic of Finland, subject to compliance by them with the provisions of the Agreement and of this Protocol.

Article 3

Fishing may be carried on throughout the year by means of trawls and nets and by hook and line. Sealing may also be carried on throughout the year.

Article 4

The lists, provided for in article 6 of the Agreement, of persons and vessels engaging in fishing or sealing during the six-month periods beginning on 1 January and 1 July shall be transmitted by the Finnish frontier authorities to the Soviet frontier authorities not later than fifteen days before the beginning of the said periods.

Article 5

The frontier authorities of the Republic of Finland shall notify the frontier authorities of the Union of Soviet Socialist Republics of all Finnish vessels proceeding to the area referred to in article 1 of this Protocol for purposes of fishing or sealing.

Article 6

Finnish vessels proceeding to the aforementioned area for purposes of fishing or sealing may cross the State frontier of the USSR in the section of that frontier extending from the point whose co-ordinates are 60°13'42" north latitude and 27°27'50" east longitude to the point whose co-ordinates are 60°08'49" north latitude and 27°04'36" east longitude.

Article 7

The necessary entries, specifying that they apply to fishing or sealing in the area defined in this Protocol, shall be made in the fishing passes, permits and lists provided for in the Agreement.

Article 8

This Protocol shall be ratified. The exchange of the instruments of ratification shall take place as soon as possible in Moscow.

The Protocol is concluded for a term of five years and shall enter into force on the date of the exchange of the instruments of ratification.

If, not less than six months before the end of the said five-year term, neither Contracting Party gives notice of its desire to terminate this Protocol, it shall remain in force for successive one-year terms throughout an additional five-year period, on condition that either Contracting Party may terminate the Protocol by giving notice to that effect not less than six months before the end of the current one-year term.
